Jean Deliso has been named a member of the 2015 Chairman’s Council of New York Life. Members of the elite Chairman’s Council rank in the top 3% of New York Life’s sales force of more than 12,000 licensed agents in sales achievement. Deliso has accomplished this level of achievement after 30 years in the financial-services industry. Her passion for finance and strategic planning led to the creation of Deliso Financial and Insurance Services in 2000. She began her career in corporate accounting in Tampa, Fla., where she consulted with small-business owners on financial operations and maximizing performance. Deliso has been a New York Life agent since 1995, and is associated with New York Life’s Connecticut Valley General Office in Windsor, Conn. She serves on many boards in her community, including the Baystate Health Foundation and Pioneer Valley Refrigerated Warehouse, and is chairman of the board of the Community Music School of Springfield. HOLYOKE — The Human Service Forum (HSF) will welcome attorney Steven Schwartz, litigation director for the Center for Public Representation, on Wednesday, Nov. 18 for a presentation titled “The ADA: Successes and Challenges for Ensuring Full Equality.”

This past July, America marked the 25th anniversary of the Americans with Disabilities Act (ADA), the landmark civil-rights law designed to promote full citizenship and equal opportunity for individuals with disabilities. But how much has that promise been realized? Like most visionary laws and social reforms, only somewhat. In certain arenas, like equal employment opportunities, the past quarter-century has been marked by a series of disappointing Supreme Court decisions, consistent (more than 90%) court victories for employers who refuse to hire or accommodate employees with disabilities, and even a major legislative initiative to amend the ADA to rebalance the legal landscape.

In other areas, and especially with respect to the historical segregation of persons with significant disabilities, the ADA has radically restructured the provision of public services in many state systems, and created a warning signal to those states which refuse to integrate their public and private programs.

Both of these trends are likely to continue for the next decade, with new targets for the ADA’s integration mandate and, most importantly, a profound cultural change in public awareness of the contributions of citizens with disabilities in all aspects of community living.

SPRINGFIELD — White Lion Brewing Co. and the Student Prince will celebrate Suit Up Springfield’s first-year anniversary with a Bowties and Beers community-wide fund-raiser tonight, Nov. 13, at the Student Prince, 8 Fort St., Springfield.

The event, from 5:30 to 8:30 p.m., will feature a draft-beer lineup by White Lion, and the Student Prince will donate 10% of all food and beverage proceeds from the evening to Suit Up Springfield to supports its mission.

Suit Up Springfield was founded by Justin Roberts, Development officer at American International College, to promote self-sustainability among men seeking employment through the provision of interview attire and professional mentorship. Roberts recently completed his term as board president, and the board of directors will introduce its incoming president tonight.

Men’s professional clothing donations are encouraged, and can be made at the door of the event. All proceeds go directly to helping Suit Up Springfield continue to provide attire along with the personal and professional development and mentorship programs to Springfield men.

In July 2013, when Springfield voters approved MGM’s development of an $800 million hotel-casino complex in our downtown, it was an historic event and the culmination of a two- year process. The vote backed a vision of transformation for an area destroyed by a tornado and a city devastated by the loss of manufacturing jobs. As I stated then, the proposal would not be a panacea, but, as the largest development in the history of Western Massachusetts, the benefits outweighed the costs, and it was worth pursuing.

In addition to local approval, last November in a state-wide referendum, support from voters in virtually every city and town across the Commonwealth validated our selection process. In fact, the Mass. Gaming Commission recommended to the Japanese government, which is considering legalizing casinos, that they study Springfield’s selection process. Based on their recommendation, last month the Japanese government sent its representatives to interview me and our internal team about how we established the process.

However, I have always known that, no matter how successful we were in attracting and reaching a contract with one of the largest corporations in the entertainment and gaming industry, the most difficult part would be making sure that the development was completed as promised.

To assist us in the enforcement of the promises made by MGM, we have a binding host community agreement with enforceable legal remedies and damages for non-compliance. In addition, I have the assurances of the chairman of the Mass. Gaming Commission that he will defer to the City’s design concerns in the commission’s enforcement of MGM’s gaming license conditions.  These tools will allow us to keep MGM’s feet to the fire, and should assure the naysayers that, working together, we can be successful in seeing the fruits of our labor and our hopes and expectations realized.

Indeed, these tools already helped us negotiate through the I-91 delay, and I will continue to aggressively enforce the binding agreement in the negotiation of any changes that are in the best interests of the city. As further proof that this process works, although I initially was skeptical about losing the original glass tower, I now believe that the benefits to our community of relocating the market-rate housing offsite outweigh the intangible, yet perceived, loss of a new addition to Springfield’s skyline.

Now, a new challenge is presented by MGM’s proposal to reduce the size of the original project. I pledge that I will not agree to any changes that negatively affect MGM’s promises of employment opportunities and revenue. We again will utilize our consultants to assure that the city is protected as we review and negotiate over the latest proposed changes. MGM will pay for our review costs including our team of gaming law, design, and engineering experts that have been with us since the beginning of our casino selection process.

I have asked my internal team, together with our outside experts, to provide me and the City Council with the analyses that we need to make decisions in the best interest of the city. I am confident that our rigorous review process will result in the city realizing the vision it had when it selected MGM: developing a first-class resort casino project benefitting the city, region and Commonwealth. I will settle for nothing less.

Springfield Regional Chamber Merger Approved

SPRINGFIELD — The Massachusetts secretary of state has given final approval to the merger between the Affiliated Chambers of Commerce of Greater Springfield (ACCGS) and the Springfield Chamber of Commerce to officially form the Springfield Regional Chamber. At a meeting of both the ACCGS and the Springfield Chamber, the membership of the ACCGS and the Springfield Chamber voted in person and by proxy to unanimously approve the merger and create the new organization. The creation of one unified organization was the result of more than two years of discussions, comprehensive analyses, reviews of best practices, and benchmarking against chambers across the country. Under the previous model, the ACCGS served as an umbrella organization providing services and benefits to a collective of affiliate chambers: the Springfield Chamber of Commerce, the Professional Women’s Chamber of Commerce (PWC), and the East of the River Five Town Chamber of Commerce (ERC5). The new organization reflects the merger of the ACCGS and Springfield into one organization. “Our region is one economic marketplace,” said chamber President Jeffrey Ciuffreda. “This merger better reflects the regional thinking of our membership, and, as a result, we have a clearer and strengthened vision, stronger collaborations with existing regional partners, and greater opportunities for new ones. It enables the chamber to grow so that its members can grow, too.” He added that the move “also allows us to have a stronger, more unified voice to better shape policy on Beacon Hill and in Washington,” and noted that the merger also allows the chamber to have an increased regional presence to help drive growth, a more cohesive structure, operational efficiencies, and more effective and impactful use of resources. “In the end, this merger should provide for an increased level of service to our members so that we can maximize their financial investment in us.” While the ERC5 voted not to merge, the Springfield Regional Chamber will continue to provide services to these members through the remainder of their membership term. “We continue to work with the ERC5 and its leadership to identify mutually beneficial ways to work together to strengthen the region as a whole,” said Ciuffreda. Meanwhile, the Springfield Regional Chamber has debuted its new logo. According to Nancy Creed, the chamber’s vice president of marketing and communications, the new logo has a more modern look. “We wanted the logo to better reflect what we do rather than who we are,” she said. “Many still don’t understand what a chamber does, but this logo, specifically the words ‘Connect to Commerce,’ clearly reflect our purpose.” The logo, created by Creed with assistance from consultant Gary Czelusniak, centers around the number two because, as Creed noted, “partnerships take two for success — the chamber and a business, the chamber and the region, the chamber and its members, not to mention the businesses and consumers, businesses and employees, and the list goes on. Success is all about working together and building relationships.” She said the choice of colors also are significant, noting that orange represents enthusiasm, creativity, success, strength, and endurance, and is a color highly accepted among the younger generations. “Believe it or not, seeing the color orange actually increases the oxygen supply to the brain and stimulates mental activity, and people associate orange with good value.” She said grey, on the other hand, is associated with power, strength, authority, prestige without being overly formal, reliability, and stability. “Grey is also perceived as long-lasting and classic. That holds true for us since we have been connecting people to commerce for more than a century.” Springfield Regional Chamber members in good standing can use the new logo on their websites as a means of communicating to consumers their commitment and investment in the chamber. The chamber is also working on a new website, www.springfieldregionalchamber.com, and chamber staff have all transitioned to the new domain name for their e-mail addresses.

Single-family Home Sales Up in Pioneer Valley

SPRINGFIELD — The Realtor Assoc. of Pioneer Valley reported that single-family home sales in September were up 19% across the Valley compared to the same time last year. The median price is up 4.1% from $191,750 last year at this time to $199,700 this year. In Hampden County, sales were up 12.2% and median price up 7.1% from September 2014, while in Hampshire County, sales were up 45.2%, and median price was up 1.9%. In Franklin County, sales were up 15.4%, but median price was down 8.8%.

State Unemployment Drops in September

BOSTON — The state’s total unemployment rate dropped to 4.6% in September, the Executive Office of Labor and Workforce Development announced Thursday. The preliminary job estimates from the Bureau of Labor Statistics indicate Massachusetts lost 7,100 jobs in September. The job losses occurred in the education and health services; trade, transportation, and utilities; construction; and manufacturing sectors. However, year-to-date, Massachusetts has added 46,900 jobs. The preliminary estimates show 3,406,700 Massachusetts residents were employed in September, and 163,100 were unemployed, for a total labor force of 3,569,800. The labor force decreased by 21,900 from 3,591,700 in August, as 17,200 fewer residents were employed and 4,600 fewer residents were unemployed over the month. The statewide unemployment rate in August was 4.7%. Over the year, the state’s seasonally adjusted unemployment rate fell 1.0% from 5.6% in September 2014. The September state unemployment rate remains lower than the national rate of 5.1% reported by the Bureau of Labor Statistics. “The Massachusetts unemployment rate continues to decline. Although the state experienced job losses in September, the overall jobs picture is strong,” Labor and Workforce Development Secretary Ronald Walker II said. The state’s labor force participation rate — the total number of residents 16 or older who worked or were unemployed and actively sought work in the last four weeks — decreased 0.4% to 64.9% over the month. The labor-force participation rate over the year has decreased 0.6% compared to September 2014. September 2015 estimates show that 3,406,800 residents were employed, and 163,100 were unemployed. There were 35,400 fewer unemployed persons over the year compared to September 2014. The largest private-sector percentage job gains over the year were in professional, scientific, and business services; leisure and hospitality; and education and health services.

State Receives Grant for Apprenticeship Programs

BOSTON — The state’s Executive Office of Labor and Workforce Development was awarded a $2.9 million federal grant to expand apprenticeship opportunities in high-growth industries in Massachusetts. The American Apprenticeship Grant, awarded by the U.S. Department of Labor, will enable the state to help 300 residents gain apprenticeship training in industries with a growing demand for new employees, such as healthcare, technology, and advanced manufacturing. The funds will support the Massachusetts Apprenticeship Initiative (MAI) to increase the number of apprenticeship and pre-apprenticeship opportunities in those industries. There are more than 7,500 registered apprentices in the state in 2015. “As many employers in Massachusetts struggle to find the skilled labor to fill available jobs, this grant will enable training for individuals in high-demand industries and provide more job opportunities for the people of the Commonwealth,” Gov. Charlie Baker said. The U.S. Department of Labor awarded $175 million in American Apprenticeship Grants to 46 awardees across the nation to expand apprenticeships in high-growth industries. The Executive Office of Labor and Workforce Development will use the grant to build upon apprenticeship opportunities and address the skills gap for underserved residents. “Our team worked incredibly hard to be awarded one of these highly competitive grants,” said Labor and Workforce Development Secretary Ronald Walker, II, who chairs the Workforce Skills Cabinet. “These funds will help us in our mission to meet employers’ demands for highly skilled workers so they can continue to grow their businesses. Businesses cannot grow if they cannot find enough skilled workers.” Created by the governor through an executive order, the Workforce Skills Cabinet’s goal is to align education, economic- and workforce-development programs, and policies to increase opportunities for training and employment for residents while helping businesses meet their growth needs.

Governor Files Landmark Substance-abuse Legislation

BOSTON — Continuing a series of initiatives to combat the opioid epidemic, Gov. Charlie Baker unveiled legislation to provide medical personnel with the power to intervene with patients suffering from addiction, control the spread of addictive prescription opioids, and increase education about substance-use disorder for providers and in the community. The bill, titled “An Act Relative to Substance Use Treatment, Education and Prevention,” contains several additional provisions developed by the Governor’s Opioid Working Group to address prevention, intervention, treatment, and recovery. “Combating the opioid epidemic in the Commonwealth calls for a comprehensive approach, and filing today’s landmark legislation is a critical step toward creating more effective treatment pathways and better controlling opioid-prescribing practices for first-time patients,” Baker said. “Our administration has already implemented a series of the working group’s recommendations to tackle this epidemic from every angle, ranging from prevention to recovery support.” This bill calls for new requirements for practitioners, educators, and communities and amends the civil-commitment statute to specify that women committed for substance-use treatment may be sent to new secure treatment units approved by the departments of Public Health and Mental Health, and ends the practice of sending women to MCI Framingham for treatment. Further, medical professionals will be granted the authority to involuntarily commit an individual for treatment for 72 hours if they pose a danger to themselves or others. Currently, individuals suffering from substance-use disorders can be held for treatment only through an order from the courts, which are not always in session, limiting access for families and patients in need of a 24-hour ‘front door’ to treatment for a substance-related emergency. To better control opioid-prescribing practices, the legislation contains a provision limiting patients to a 72-hour supply the first time they are prescribed an opioid or when they are prescribed an opioid from a new doctor. Practitioners will also be required to always check the Prescription Monitoring Program (PMP) prior to prescribing an opioid to a patient, and will be required to fulfill five hours of training on pain management and addiction every two years.

International Container Co. Plans Holyoke Facility Expansion

HOLYOKE — In an effort to accommodate a growth in production, International Container Co., LLC will build an expansion to its facility and operations headquartered at 110 North Bridge St. in Holyoke. The expansion is planned with the assistance of both local tax incentives and tax credits provided through the Commonwealth’s Economic Development Incentive Program (EDIP).
International Container Co. (ICC) purchased its 150,000-square-foot facility in Holyoke in 2001 and has since made many improvements to the property. Since moving to Holyoke, business has increased each year for the company. The tax-increment financing (TIF) agreement lasts for five years and allows for a property-tax exemption on the newly created real-estate value. In return, ICC has agreed to create a minimum of five new jobs and invest between $900,000 and $1 million in the project.
The agreement has been submitted to the Holyoke City Council for approval. In addition, ICC will receive state investment-tax credits, pending review and approval of the application by the Mass. Economic Assistance Coordinating Council, based on the amount of sales generated from the expansion.
“The expansion of International Container is another indicator that manufacturing is alive and well in Holyoke,” Mayor Alex Morse said. “Our city’s manufacturers are a vital part of the community and our economy. This local incentive will ensure that this project can be brought to completion to retain and create dozens of employment opportunities in our own backyard.”
Over the last two years, ICC has made substantial efforts to expand, now servicing all of New England and selling products across the U.S. ICC currently employs 45 people, noting a growth in employment since 2013 when there were 24 employees at the facility.
“We are very excited to be working with the city of Holyoke on our expansion project,” said Joseph Searles, general manager of International Container.

Curry Printing Changes Logo to Reflect Shift in Business

WEST SPRINGFIELD — Curry Printing in West Springfield is changing its logo to better reflect its core business.
Since opening in 1976 as Curry Copy Center, the printing business has experienced a paradigm shift. “Ninety-eight percent of what we do today is print, and not copy,” owner Stephen Lang said. “In the old days, customers would come in with their camera-ready originals. We would make a plate and then run off copies. Today, those originals are electronic files sent directly as e-mail attachments or uploaded on our website. No plates need to be made; we print direct to different devices depending on the job. Blueprints, full-color brochures, reports, manuals, newsletters, banners, signs, and all kinds of collateral material go direct to print.”
To reflect this change, Curry has updated its logo. “It’s still OK to call us Curry Copy if you want; we really don’t mind,” Lang said. “But we are so much more than copies these days.”

EAST LONGMEADOW — Aaron Smith, P.C., a certified public accounting firm serving individuals and businesses in the Pioneer Valley, supplied 10 volunteers for the United Way of Pioneer Valley Day of Caring last month. The Day of Caring is the largest day of service in the Pioneer Valley, bringing more than 1,000 people together to complete community-service work throughout the region. Aaron Smith employees participated in the Day of Caring by working with a local YMCA to close up a summer camp for the season. Camp Weber, part of the West Springfield YMCA, has been serving young people for more than 150 years. Generations have enjoyed the 75 acres of wooded property located on Dewey Street, which needs a thorough cleaning at the beginning and end of each season. “It was a pleasure working with Camp Weber as part of the United Way Day of Service,” said Joanna Smigiel of Aaron Smith. “We helped by sweeping out the various buildings at the camp and cleaning refrigerators, sinks, cabinets, and washrooms. SPRINGFIELD — Transgender identity and gender transition have taken center stage in the media in recent weeks, but the rights of transgender individuals in the workplace are still unclear to many. Several federal agencies — including the Equal Employment Opportunity Council (EEOC) — have created or revised policies to protect transgender individuals from discrimination in the workplace. These policies set forth what business owners must know to protect themselves and their employees, according to local employment law attorney, Marylou Fabbo.

A partner at Springfield-based Skoler, Abbott & Presser, P.C., attorney Fabbo has been selected to discuss transgender discrimination in the workplace during the 20th annual Advanced Employment Issues Symposium (AEIS) in November.

“Employers are required to provide equal opportunity to people who are lesbian, gay, bisexual and transgender (LGBT),” said Fabbo.” There is absolutely no excuse for not treating transgender employees with dignity and respect. It is especially important with the recent stance of various federal agencies that employers take proactive measures to insure that employees transitioning and those who have transitioned are treated in the same manner as all other employees. Human resource management should draft transition policies and educate employees accordingly.”

Just days after the Occupational Safety and Health Administration (OSHA) published “A Guide to Restroom Access for Transgender Workers” to advise employers on ways to accommodate transgender employees, four federal government agencies with roles in ensuring fairness in the federal workplace — the Office of Personnel Management, the EEOC, the Office of Special Counsel, and the Merit Systems Protection Board — released a guide on the rights of employees who allege sexual orientation or gender identity discrimination. The guide, which was reissued after more than a decade, has been substantially revised to reflect major recent developments in the law.

“The guide from OSHA addresses a very specific area of the workplace: the restroom,” said Fabbo. “Among the concerns of employers are the reactions of coworkers regarding a transitioning employee’s restroom use. The core principle of the OSHA guide is that transgender employees should have access that corresponds to their gender identity. Restroom access for transgender individuals has generated controversy — especially in recent weeks — and led to claims of discrimination.”

Employers that don’t respect a transgender worker’s restroom choice, for example, could run the risk of potential liability under Title VII of the 1964 Civil Rights Act. Among the best practices for providing restroom access for transgender employees are:
• Single-occupancy gender-neutral (unisex) facilities, and
• Use of multiple-occupant, gender-neutral restroom facilities with lockable single-occupant stalls.

According to a 2013 study by Fenway Health, 65% of Massachusetts’ transgender population have experienced discrimination in public settings — including being denied access to public restrooms. On July 11, during Boston Pride Week, a celebration of the LGBT population, Boston Mayor Marty Walsh signed an executive order to immediately establish gender-neutral restrooms outside his office in Boston City Hall.

“State and federal agencies are speaking out and changing policies,” said Fabbo. “OSHA has stated that failure to provide appropriate restrooms for transgender employees might be an OSHA violation because it is a health and safety hazard. In the past five years – and especially within the last few months – the topic of transgender equality has been steadily on the rise and employers should be prepared to address it.”

The Advanced Employment Issues Symposium will be held Nov. 4-6 in Las Vegas, bringing together employment law attorneys and human resource experts to deliver compliance guidance and strategic HR solutions. Fabbo will present Gender Identity and Expression: Accommodations and Conversations Related to Transgender and Gender Non-Conforming Employees at the symposium Nov. 6. The presentation will highlight the proactive approach employers should take to ensure policies and practices related to dress, use of bathroom facilities and other issues are handled in a legally compliant and respectful manner.

HOLYOKE — In an effort to accommodate a growth in production, International Container Co., LLC will build an expansion to its facility and operations headquartered at 110 North Bridge St. in Holyoke. The expansion is planned with the assistance of both local tax incentives and tax credits provided through the Commonwealth’s Economic Development Incentive Program (EDIP).

International Container Co. (ICC) purchased its 150,000-square-foot facility in Holyoke in 2001 and has since made many improvements to the property. Since moving to Holyoke, business has increased each year for the company. The tax-increment financing (TIF) agreement lasts for five years and allows for a property-tax exemption on the newly created real-estate value. In return, ICC has agreed to create a minimum of five new jobs and invest between $900,000 and $1 million in the project.

The agreement has been submitted to the Holyoke City Council for approval. In addition, ICC will receive state investment-tax credits, pending review and approval of the application by the Mass. Economic Assistance Coordinating Council, based on the amount of sales generated from the expansion.

“The expansion of International Container is another indicator that manufacturing is alive and well in Holyoke,” Mayor Alex Morse said. “Our city’s manufacturers are a vital part of the community and our economy. This local incentive will ensure that this project can be brought to completion to retain and create dozens of employment opportunities in our own backyard.”

Over the last two years, ICC has made substantial efforts to expand, now servicing all of New England and selling products across the U.S. ICC currently employs 45 people, noting a growth in employment since 2013 when there were 24 employees at the facility.

A quarter-century after its inception, the Super 60 program continues to document not only the growth and sustained success of area businesses, but the vitality of the local economy.

The Springfield Regional Chamber — formerly the Affiliated Chambers of Commerce of Greater Springfield — has been issuing annual lists of its largest-revenue and fastest-growing members since 1990, documenting, over time, the businesses that keep the region running.

“There’s a reason we break it down by Revenue Growth and Total Revenue,” said Jeffrey Cuiffreda, Springfield Regional Chamber president. “I think it shows we have a lot of mature industries on the largest-revenue list, and to get to that level, you have to be around a long time and have a stable base, and that shows the good foundation of our economy.

“At the same time,” he went on, “we’re finding newer and newer companies that come along, and that’s oftentimes where the growth comes from. There’s usually a good cross-section of industries there, which shows the diversity of the growing companies that add to our employment base.”

Being named to the Super 60 has also become a bragging right for businesses large and small, and a highly anticipated fall tradition. The Super 60 companies will be honored at a luncheon on Friday, Oct. 23 from 11:30 a.m. to 1:30 p.m. at Chez Josef in Agawam, presented by Health New England and sponsored by Berkshire Bank, WWLP-TV22 News, and Zasco Productions.

To be considered, companies must be headquartered in Hampden or Hampshire counties or be a member of the Springfield Regional Chamber, have revenues of at least $1 million in the last fiscal year, be an independent and privately owned company, and have been in business at least three full years. Companies are selected based on their percentage of revenue growth over a full three-year period or total revenues for the latest fiscal year.

“Small business is the backbone of our region, and the success of this year’s winners is a clear indication that our regional economy is strong,” Ciuffreda said, adding that, while all winners in the Total Revenue category had revenues in excess of $4 million, one-third exceeded $30 million. The Total Revenue winners combined for more than $1 billion in revenues.

In the Revenue Growth category, all winners had growth in excess of 20%, while one-third had growth in excess of 65%. In addition, 11 companies in the Total Revenue category also qualified for the Revenue Growth category, and 19 companies in the Revenue Growth category also qualified for the Total Revenue category. Each was placed in the list where it ranked highest.

Topping the Total Revenue category is NUVO Bank & Trust Co. in Springfield, followed by Whalley Computer Associates Inc. in Southwick and Sarat Ford-Lincoln in Agawam. In the Revenue Growth category, Springfield-based City Enterprise Inc., a woman-owned commercial and residential builder, finished on top for the second straight year, followed by Aegenco Inc. in Springfield and Holyoke Community College Foundation Inc.

BOSTON — Should a landlord’s mistake handling a security deposit give a tenant a defense against eviction? That is the question the Supreme Judicial Court (SJC) will decide after hearing oral arguments on Thursday, Nov. 5, a decision that could have major ramifications for landlord-tenant law and rents in Massachusetts. On Tuesday, the court received an amicus brief from Amherst attorney Peter Vickery on behalf of the statewide group MassLandlords.net.

“The short answer is no,” says Vickery. “A security-deposit mistake does not give a tenant a defense against a landlord’s claim for possession.”

The question came up in the case of Meikle v. Nurse, where the landlord had not followed all the rules regarding security deposits. The judge allowed the tenant’s security-deposit counterclaim, but — because the dollar value of the counterclaim was outweighed by the rent the tenant owed — the judge granted the landlord possession. The tenant, represented by the Harvard Legal Aid Bureau, appealed, and the SJC opted to take it up from the Appeals Court’s docket.

“It’s about the distinction between a counterclaim and a defense,” said Vickery, whose practice focuses on civil litigation, particularly in the areas of landlord-tenant and employment law. “Nobody disputes that, if a landlord who is suing for rent and possession has violated the security-deposit laws, then the tenant can raise that as a counterclaim. The statute makes that clear. The statute also says that some claims and counterclaims can also serve as defenses. There’s a list of them in Chapter 239, Section 2A. Security-deposit violations are not on that list.”

According to the brief filed by the Harvard Legal Aid Bureau, the counterclaim is also a defense because another part of Chapter 239 (Section 8A) says that a tenant may raise any claim “by defense or counterclaim.” But, Vickery argues, the word ‘or’ really matters.

“The word ‘or’ is disjunctive,” he noted. “Colloquially we use it to mean ‘and/or,’ but in statutes and other legal documents, it means ‘one but not both.’ If the Legislature had intended to abolish the distinction between counterclaims and defenses, it would have done so. But instead it used the word ‘or.’ And it could have included security-deposit violations in the list of defenses in section 2A, but it chose not to.”

Security deposits are supposed to help a landlord guard against the risk of property damage. But many landlords are already reluctant to take security deposits because the rules about them are complicated and it is easy to make a mistake.

“We routinely receive requests for help where either the landlord or in some cases the bank has messed up compliance with the complicated security-deposit law,” said Doug Quattrochi, executive director of MassLandlords.net. “It’s not surprising Harvard Legal Aid is confused.”

Even a simple mistake can lead to the landlord paying the tenant treble damages (three months’ rent) plus legal fees. This encourages landlords to refuse security deposits and lower risk through higher rents. If the SJC decides that security-deposit violations do give rise to a defense against possession, even fewer landlords will ask for security deposits, and rents will rise accordingly.

SPRINGFIELD — Advanced manufacturing in New England and the skills gap will be discussed as part of a national report produced by Deloitte Consulting, LLP and the New England Council at the Professional Women’s Chamber (PWC) Headline Luncheon at the Western Mass. Business Expo on Wednesday, Nov. 4, from 11:30 a.m. to 1 p.m. at the MassMutual Center.

Alison Lands, senior manager for Deloitte Consulting’s Strategy and Operations practice and co-author and editor of “Advanced to Advantageous: The Case for New England’s Manufacturing Revolution,” will present highlights of the report as well as the strength of this backbone industry and the skills-gap challenges facing it.

According to the report, the industry sector has evolved to encompass aerospace and defense, medical devices and biotechnology, complex electronics, precision machining and optics. Despite the difficulties of the recession, advanced manufacturing has proven to be a resilient sector of the economy and is poised for a revolution.

However, it faces numerous challenges. It no longer relies on unskilled labor but rather requires a workforce skilled in technology, innovation and information. In addition to a generation of workers facing retirement, there exists a dearth of skilled workers qualified to work in manufacturing as well as an underskilled labor pool to fill available job vacancies within the industry. In addition, the report notes, the industry “suffers from a lack of brand awareness that keeps talent at arm’s length from meaningful employment opportunities.”

Lands will discuss the evolution of the industry, the challenges associated with such a skills gap, and the opportunities that New England can capitalize on to serve as accelerators for growth.

With a background in economics and more than 15 years of experience in public administration and professional services, Lands partners with leaders of state, local, and regional agencies to achieve results in the areas of health and human services, economic and workforce development, disaster recovery and resiliency, and transportation.

She holds a master’s degree in public and economic policy with a concentration in urban policy from the London School of Economics, a master’s degree in public administration with a concentration in urban policy from Columbia University’s School of International and Public Affairs, and a bachelor’s degree from Trinity University.

Some people have a clear idea of how they want to live once they stop working. For many others, however, retirement is a step into the great unknown. The problem is, without a road map for turning your savings into a sustainable stream of income, it’s difficult to create the type of lifestyle you want for the future.

Planning for retirement is a lifelong process that should begin as soon as you start working and continue throughout your retirement years. Whether you are five years from retiring or 30, the following steps can help you achieve financial security for when the big day finally comes.

1. Practice Retirement

Like most people, you may spend years fantasizing about the day when you can finally stop working. But what will your retirement look like? Financial experts recommend that you think about what you want to do when you retire and then ‘practice’ some of it first.

For example, if you’d like to move to a warmer climate, try vacationing there several times to get a sense of what it might cost and how it feels not just in the winter, but in the heat of summer. Or, if you plan to watch your grandkids full time, take a week or two to do a test run. The goal is to try out your plans, determine whether you truly enjoy and can afford them, and make needed adjustments before you commit.

2. Match Your Expenses and Income

As you think about your lifestyle in retirement, your expenses will fall into two groups: essential expenses (your needs) and discretionary expenses (your wants). Within discretionary expenses, you also may have one-time expenditures, such as funding a grandchild’s education or adding a sunporch to your home. Whether you make a spreadsheet on your computer or simply list your expenses on a pad of paper, the goal is to create a retirement budget that captures as many anticipated costs as possible.

Next, consider the money you’ll have coming in. Typically, retirees draw from three categories of income in retirement: guaranteed sources of income (such as Social Security, pensions, and lifetime income annuities), savings and investments, and any employment income.

Once you know what you’re likely to have coming in, pair your income and expenses based on their priority, matching your needs with your guaranteed income sources first. If the predictable income you expect won’t cover all your essential expenses, you may want to either adjust your plans or consider converting a portion of your savings into a regular stream of income. Conversely, if you have a surplus, you can use the extra money to cover any discretionary expenses.

3. Decide Which Account to Tap First

One way to maximize the amount of money you may have in retirement is by planning the order in which you spend your different investment accounts. The starting point is to consider whether you plan to use your assets for ongoing expenses in retirement or to pass them along to your heirs or charities.

For many, it makes sense to draw from taxable accounts first in order to keep the assets in retirement accounts growing tax-deferred for as long as possible. Tax-exempt accounts, such as Roth IRAs, should be spent last. However, there is no rule of thumb when it comes to the order in which you should liquidate your assets.

If you plan to pass your assets along to your heirs or charities, you may want to spend tax-deferred assets with the intention of bequeathing taxable assets, which receive more favorable tax treatment when inherited.

The order in which you withdraw your retirement savings is an important decision that becomes even more complex once you reach age 70½. That’s when you must begin taking annual required minimum distributions from your IRAs and retirement plans.

Because each person’s situation is unique, you should include both your financial professional and tax advisor in these discussions.

4. Protect Your Savings

Consider putting enough money into a savings or liquid money-market account to cover your withdrawal needs for at least two years. This can help prevent taking money out of your investments when the market and share prices are trending downward.

If you haven’t already, consider funding a long-term-care (LTC) plan as well. LTC funding can help protect your retirement nest egg from the financial impact of the costs of extended care either at a facility or in your home.

5. Fine-tune Along the Way

Spending retirement assets can be even more complex than building them. Your retirement savings need to provide reliable income to meet your ongoing expenses for the rest of your life. Reviewing your plan annually and keeping it current is vital to making this happen.

Consider just some of the things that can change in a year: your marital or health status could change, your investment returns and inflation rate could fluctuate, and your employment status and expected retirement date might shift. Each of these can have a profound impact on the amount of money you may have to spend in retirement.

That’s why it’s important to work with a financial professional who understands that retirement planning is an ongoing process — someone who knows what it takes to accumulate assets for retirement, mitigate the risks that can affect your retirement years, and turn your funds into a distribution plan designed to generate sufficient income to meet your lifestyle needs for as long as you need it to.

MGM Springfield Presents Updated Design to City

SPRINGFIELD — MGM Springfield announced it has presented updated renderings and new details of its design to the city of Springfield. The new drawings are the result of a complete site-plan review driven by several factors, including a one-year opening-date extension, final directives on historic property use, construction market trends, and in-depth conversations with Mayor Domenic Sarno and city officials. In a letter to the mayor, MGM executives hailed the new design as a better approach to immediately activating the Main Street corridor and spurring new economic development, while reconfirming September 2018 as the completion date. “I believe this is one of the most exciting moments in the history of MGM Springfield,” said Michael Mathis, MGM Springfield president. “As we collaborate with the city on what is best from an economic-development perspective, the finer details are taking shape, and our programming is improving minute by minute.” This more integrated urban design features off-site residential space, which opens up room for a Main Street hotel that would encourage tourists and visitors to more readily engage Springfield’s downtown. Conversations are underway with property owners of nearby potential residential sites that would complement the resort-casino development. As the final design evolves, the project will feature a new five-story hotel atop a floor of retail, creating an improved scale on Main Street. The 250-room hotel would now become the eastern anchor at Howard Street of the 14.5-acre development. “This design brings to life our commitment to develop new residential activity in downtown Springfield,” Mathis noted. “Through our extensive and detailed review, we determined off-site residential would more quickly encourage ancillary development across the downtown. We are currently talking to potential partners in developing market-rate residential units.” Under the revised design, the historic columned façade at 73 State St., which had been the iconic focal point for the hotel tower, will remain as such for the updated structure, which will be home to what is tentatively being called the South End Market. With floor-to-ceiling windows, the market will be an inviting, trendy gathering space featuring local and national food and beverage vendors. “We have never lost sight of how important it is to integrate our development and its unique design needs with this historic New England downtown,” Mathis said. “We think the changes along Main Street and this new layout are more in line with a true downtown mixed-use development that will make MGM Springfield the premier urban resort in the industry.”

EANE Releases Insurance & Benefits Survey

AGAWAM — The Employers Assoc. of the NorthEast announced its findings from the 2015 Insurance & Benefits Survey, conducted earlier this year, with 121 companies participating from Connecticut, Massachusetts, and Rhode Island. The survey posed more than 130 questions. It covered health insurance, including cost, coverage, eligibility, and employee cost sharing. It also addressed retirement plans, disability benefits, and voluntary benefits. The greatest change in the survey findings continues to be in health insurance. Employers will offer, or have introduced, methods to control costs, while attempting to comply with the Affordable Care Act. These methods include shifting deductible costs and co-share to employees by altering plan design. More specifically, the survey indicates the employers’ contribution towards an employee’s coverage option has decreased from 2013 levels. While monthly premiums illustrate minimal changes, the annual deductible per person and per family has increased. As a result, employers have reassessed their benefit packages, and long-term-care benefits are affected. “Everyone is looking at the bottom line, and controlling healthcare costs is often on the top of that list,” said Mark Adams, director of HR Solutions for EANE. “That said, employers want to remain attractive to new employees and preserve their benefit packages.”

State Receives Grant for Apprenticeship Programs

BOSTON — The state’s Executive Office of Labor and Workforce Development was awarded a $2.9 million federal grant to expand apprenticeship opportunities in high-growth industries in Massachusetts. The American Apprenticeship Grant, awarded by the U.S. Department of Labor, will enable the state to help 300 residents gain apprenticeship training in industries with a growing demand for new employees, such as healthcare, technology, and advanced manufacturing. The funds will support the Massachusetts Apprenticeship Initiative (MAI) to increase the number of apprenticeship and pre-apprenticeship opportunities in those industries. There are more than 7,500 registered apprentices in the state in 2015. “As many employers in Massachusetts struggle to find the skilled labor to fill available jobs, this grant will enable training for individuals in high-demand industries and provide more job opportunities for the people of the Commonwealth,” Gov. Charlie Baker said. The U.S. Department of Labor awarded $175 million in American Apprenticeship Grants to 46 awardees across the nation to expand apprenticeships in high-growth industries. The Executive Office of Labor and Workforce Development will use the grant to build upon apprenticeship opportunities and address the skills gap for underserved residents. “Our team worked incredibly hard to be awarded one of these highly competitive grants,” said Labor and Workforce Development Secretary Ronald Walker, II, who chairs the Workforce Skills Cabinet. “These funds will help us in our mission to meet employers’ demands for highly skilled workers so they can continue to grow their businesses. Businesses cannot grow if they cannot find enough skilled workers.” Created by the governor through an executive order, the Workforce Skills Cabinet’s goal is to align education, economic- and workforce-development programs, and policies to increase opportunities for training and employment for residents while helping businesses meet their growth needs.

Project Manager Chosen for PVTA Bus Operations, Maintenance Facility

SPRINGFIELD — City Point Partners announced it has been selected by the Pioneer Valley Transit Authority (PVTA) to oversee the design and construction of the new Bus Operations and Maintenance Facility on Cottage Street in Springfield, replacing the existing, 100-year-old facility. The new, 280,000-square-foot, $70 million facility will be built on an 18-acre site and will provide bus maintenance and storage for the PVTA’s Springfield fixed-route operation. The facility will be able to accommodate approximately 150 fixed-route buses, including standard-size diesel buses and articulated buses. Included in this new facility will be management office space, fuel bays, wash bays, bus and van storage bays, garage and body-shop areas, parts storage, exercise rooms, locker rooms and showers, lounge, dispatch center, employee parking, and green spaces. A new cell tower will also be installed onsite to support the PVTA’s IT communications. The new facility will seek LEED certification under the U.S. Green Building Council’s green-building rating system. City Point Partners will provide owner’s project-management services advising with respect to the design, scope of work, cost estimating, construction manager-at-risk and subcontractor selection, schedule overview, and performance monitoring. With ridership expected to continue its steady increase and a number of high-profile development projects in the Springfield area scheduled to be completed within the next two to three years, the PVTA is planning for a greater expansion of service and consequently will require larger facilities to support this service expansion. “We are very excited to be working with City Point Partners on this critical project. A larger operations center is a vital part of supporting the expanded service that our ridership demands,” said Mary MacInnes, administrator of the Pioneer Valley Transit Authority. Added Colleen Moore, president and founder of City Point Partners, “this is a very exciting time for the PVTA. Both the public- and private-sector developments planned for the Springfield area will change the city of Springfield itself and the Pioneer Valley. State Unemployment Rate Remains at 4.7% in August

BOSTON — The state’s total unemployment rate remained at 4.7% in August, the Executive Office of Labor and Workforce Development announced. The new preliminary job estimates from the Bureau of Labor Statistics indicate Massachusetts gained 7,200 jobs in August, marking the 12th consecutive month of job gains. Year to date, Massachusetts has added 56,500 jobs. Preliminary August estimates show the number of employed residents declined by 20,600 and the number of unemployed residents decreased by 2,500, reducing the labor force by 23,100. Over the year, the state’s seasonally adjusted unemployment rate fell 0.9% from 5.6% in August 2014. The August state unemployment rate remains lower than the national rate of 5.1% reported by the Bureau of Labor Statistics. “Massachusetts continues to add jobs that strengthen our economy, and the unemployment rate is holding steady, lower than the national average,” Labor and Workforce Development Secretary Ronald Walker II said.

Nancy Shendell-Falik, who for the past two years has served in a dual position at Baystate Health as senior vice president/chief operating officer and chief nursing officer for Baystate Medical Center, has been promoted to president of Baystate Medical Center and senior vice president for hospital operations at Baystate Health. Her appointment becomes effective Oct. 1. “During her two years at Baystate, Nancy has propelled the organization as both a system leader and COO/CNO of Baystate Medical Center. Shendell-Falik holds a master’s degree in nursing from New York University and a bachelor’s degree in nursing from Rutgers College of Nursing. She was a fellow of the prestigious Robert Wood Johnson Executive Nurse Program. She holds membership in numerous professional societies and organizations, including the Mass. After 20 years at Dakin Humane Society, Executive Director Leslie Harris announced her resignation effective Oct. 2 to pursue a new opportunity at Quonquont Farm & Orchard in Whately. “Leslie’s vision and leadership has given Dakin incredible momentum and untold success stories,” said Charlotte Cathro, Dakin’s board treasurer. “Since joining the organization in 1995, Leslie grew Dakin from an all-volunteer, foster-based network to one with more than 60 employees between its two locations in Springfield and Leverett, a full-time spay/neuter clinic that has performed more than 60,000 surgeries, and a multi-million-dollar budget. Magazine Commons represents an important measure of independence

When an apartment complex owned by the Springfield-based Mental Health Assoc. was destroyed in the 2011 tornado that touched down in the city’s South End — displacing 14 MHA clients who lived there — the architects at Studio One certainly empathized, because their offices were wrecked as well.

“We really could relate,” said Christopher Novelli, one of those architects. “These people lost their homes. It’s an emotional experience. We lost our office, and Greg Zorzi, our principal, had an apartment above our office, so he lost his home as well.”

So Zorzi and his team took plenty of satisfaction in designing Magazine Commons, the new, 16-unit apartment building on Magazine Street that replaces the former residential complex on Union Street. The new structure, set to open in November, was built next to the MHA’s headquarters on Worthington Street, in the city’s McKnight district, on a formerly blighted parcel.

“We had a building on Union Street that we’d operated for 30 years, but it was completely destroyed,” said Joan Ingersoll, president and CEO of the MHA, which provides residential and support services that promote independence, community engagement, and wellness for people impacted by mental illness, developmental disabilities, substance abuse, homelessness, and other challenges. “The people scattered; some relocated in other towns, and others stayed in Springfield.”

Several will be returning this fall to Magazine Commons, which is a success story on multiple levels, said Novelli, referring to its importance to the MHA and also its development on a brownfield site the city had been anxious to clean up for some time.

“There were contaminated soils, and it was unusable for building,” Novelli said. “The city owned it for years and issued several RFPs, but there were no takers on the property. Finally, the MHA came in.”

For this issue’s focus on architecture, BusinessWest talked with Novelli and Ingersoll about how the $4.6 million project came together, and how the new building will improve the lives of its tenants.

Home Again

In the aftermath of the tornado, residents of the destroyed complex dispersed to temporary housing, Ingersoll said, but, four years later, the MHA had no problem filling the 17,000-square-foot Magazine Commons with former Union Street residents as well as new clients.

“Some people are moving in from a group home, so this is their first opportunity to live independently,” she noted. “Some already live independently, so this is a different opportunity for them; they’re excited to move in. A couple of people had been in and out of different places and had periods of homelessness, and this is brand-new, stable housing.”

Darnella Johnson, one of the individuals preparing to move in, told BusinessWest she expects it to be comfortable and safe, and appreciated its proximity to a bus line — an amenity Ingersoll said is important to clients seeking to hold down employment.

Vincent Littlejohn is one of those. “I’m looking to get a job, and living close to a bus line will help me get to a job and my [support-group] meetings,” he said, noting that he, like Johnson, is currently living in a group home and is looking forward to a new measure of independence once interior construction is complete.

The facility, built by N.L. Construction in Ludlow, includes four apartments on the first floor and six apartments each on the second and third floors. The design also includes common space as well as office space for MHA staff.

“It has a community room for skill-building opportunities like cooking lessons, classes, and gatherings for social opportunities,” Ingersoll explained. “The staff offices are on the first floor — but this is not a staffed residence; the staff are outreach staff. All the residents have a certain number of hours the staff spends with them on things they need assistance with — managing medications, going to doctor appointments, teaching them how to take public transportation, how to manage money. Some of the staff will have the building as their home base, but they don’t sleep there.”

Novelli said the interior design reflects the needs of people who live independently but still face challenges.

“The people that will live there are all capable of self-preservation, all capable of living on their own. It’s not an assisted-living facility,” he explained. “There is some extra reinforcement in the bathrooms and some higher-durability finishes — rather than using carpet, it’s all tile in the living room, so it cleans up easily.”

Another challenge was fitting the building’s exterior into the historical context of the McKnight neighborhood — typically a priority for Studio One, which has plenty of experience designing housing complexes.

“We did a study of existing housing sites, and didn’t want to replicate them,” said Novelli. “But we wanted to make sure it fit in, as far as the exterior detailing, the massing of the building, and the proportions. We had several neighborhood meetings with people in the McKnight district.

“Some of the items in the original design were cut due to budget, but we were able to keep most of the proportions they wanted,” he went on. “All 16 are one-bed units, 550 square feet with large kitchens that open to living rooms.”

Studio One’s design also complied with — and in many cases exceeded — the city’s stretch codes, which mandate strict standards for energy efficiency, he added.

“We’re going beyond that with highly efficient mechanical systems, the building envelope, and thermal details,” he said, noting that such codes are becoming industry standard in many types of buildings, just as homeowners and developers are increasingly understanding the eventual cost savings. “The main concern has always been the bottom line rather than the long term. But people are starting to realize that, if you invest money at the start, you end up saving more money.”

Community Asset

Ingersoll was quick to note that Magazine Commons represents not just a housing complex, but a $4.6 million investment in the neighborhood, including sidewalks, lighting, neighborhood stabilization, and brownfield development. And it’s not an investment in just 16 current residents, but for dozens, even hundreds more over the coming decades, all of whom are trying to get to a more secure place in life, she added.

The MHA’s development team presented the plans to the McKnight Neighborhood Council in April of 2013, at which time the council voted to support it. The project has received financial support from the city of Springfield, the state Department of Housing and Community Development, the Mass. Community Development Assistance Corp., the state Department of Mental Health, MassDevelopment, the Affordable Housing Program of the Federal Home Loan Bank of Boston, and People’s United Bank.

With about $2 million in insurance money in hand from the tornado, the multiple funding partnerships meant the MHA had to finance only about $750,000 of the overall cost. Designated a HUD 202 project for people with disabilities, the apartments are subsidized, with residents paying no more than 30% of their income and HUD picking up part of the rental cost, Ingersoll noted.

“HUD told us we could rebuild in Springfield when we got the subsidies transferred over to the new project,” she explained. “We’ve been working with the city since then to identify and agree on the land, which was, fortunately, right next door to our main offices. The land was a pretty big parcel, but it was blighted and needed cleanup. We bought it for a dollar from the city, and we were able to revitalize the whole block.”

Novelli said the design included a specialized foundation system called a geo-pier, which densifies soil underneath a structure, so it can be built on what otherwise would be considered unsuitable soil.

Despite the challenges — or perhaps because of them — he and Zorzi are gratified to help the MHA rebuild a key component of its services. Founded in 1960, the agency operates 21 sites throughout Greater Springfield and serves more than 400 people annually through its residential and outreach programs.

Magazine Commons will be staffed weekdays from 8 a.m. to 8 p.m., making the location next to MHA headquarters ideal for both residents and staff, Ingersoll added.

“It’s pretty unbelievable for the people moving in there,” she told BusinessWest. “I’ve had the opportunity to go in with some clients for the first time. When they see it, they become so excited. They think the units are beautiful. It’s a great opportunity for them.”

After all, she added, good housing is often a critical step in helping people procure good jobs and a brighter future. “It’s often the foundation for everything else in life.”

CRRC USA Rail Corp. Breaks Ground on $95M Springfield Plant

SPRINGFIELD — Gov. Charlie Baker and Springfield Mayor Domenic Sarno joined a host of local and state officials and representatives of CRRC USA Rail Corp. recently for a groundbreaking ceremony at the city’s former Westinghouse site on Page Boulevard, where the company will build its first North American plant. CRRC, a Chinese-based manufacturer of urban mass-transit vehicles, won a $565 million contract with the state last year to build nearly 300 subway cars for the MBTA’s aging Red and Orange lines — a project that promises 100-plus construction jobs from the building of a 220,000-square-foot plant, and more than 150 new manufacturing positions. CRRC visited about 50 North American sites before settling on Springfield. “Today is a great day in Springfield, and in Massachusetts, with CRRC, the largest railway company in the world, coming to Springfield,” Sarno said, noting that, while manufacturing was the city’s strong industrial base for generations, it started to erode in the 1970s, but has never gone away, and CRRC could be a catalyst to further shift the needle in a positive direction. “We now have a $95 million project here at the old Westinghouse site. This will be CRRC’s North American hub. It’s important that we use this as leverage and momentum,” the mayor said — not just for further manufacturing in Springfield, but a for a boost in regional rail service. “I’d love to see that east-west rail connecting Boston to Springfield to Washington, D.C.” While calling the groundbreaking “an exciting day for Springfield, an exciting day for the Commonwealth, and an exciting day for Western Mass.,” Baker said the MBTA is in dire need of new cars on its Red and Orange lines. During Boston’s crippling winter earlier this year, he said, it was pointed out to him that the rail cars pressing through the storms were the same ones that endured the Blizzard of ’78. “Think about that — that was a really long time ago, folks,” he told hundreds of people in attendance at yesterday’s ceremony, calling CRRC’s arrival a piece of the state’s “strategy to bring jobs, economic development, and transit improvements for the benefit of all people in the Commonwealth of Massachusetts.” Weiping Yu, vice president of CRRC Corp. Limited in Beijing, said he was “honored” to partner with officials in Massachusetts and Springfield on the $95 million construction project and the economic benefits it will generate. Yi Lu, general commercial counselor for the New York Chinese Consulate, added that he’s confident the new Springfield plant will be a strong engine for the local economy, generating hundreds of new jobs and perhaps spurring further Chinese investment in the region. “Looking back on our initial discussions when we first visited Massachusetts,” added Chuanhe Zhou, president of CRRC USA Rail Corp., “I’m proud of the strides we’ve made, the relationships we’ve built, and the partnerships we’ve formed — from meetings with city officials to tours of local manufacturers to visits to local educational institutions. We couldn’t have found a better partner than you.” Jay Ash, the state’s secretary of Housing and Economic Development, said CRRC wants to be a good neighbor by hiring local people, taking advantage of local supply chains, and engaging with companies around Western Mass. as it expands in the future. And expand it should, added Stephanie Pollack, the Commonwealth’s Transportation secretary, if only because much of the country is dealing with the same issues as Massachusetts when it comes to aging rail cars. “We know what CRRC knows, which is that the MBTA is hardly the only transit system in the United States with 1970s-era cars,” she noted. “In fact, a lot of cars in this country were bought in the 1970s with what was then a relatively young federal program for producing them.” Baker credited his predecessor, former Gov. Deval Patrick, and his team with much of the legwork to bring CRRC to Massachusetts. “They did make this day possible. Sometimes you get credit for stuff that happens on your watch, whether you had anything to do with it or not.” That said, the governor went on, “our administration is thrilled to be here today. We consider this project to be not just an important part of the economic-development story in Springfield, but an important part of the future of the MBTA and transit in Massachusetts.”

Parent Companies of Local TV Stations Announce Merger

SPRINGFIELD — Media General Inc., owner of NBC-affiliated WWLP 22 and the CW Springfield, has agreed to buy Meredith Corp., owner of WGGB abc 40, CBS 3 Springfield, and Fox 6, for about $2.4 billion in cash and stock. The combined company, Meredith Media General, will be the third-largest local television station owner, initially with 88 television stations across 54 markets that reach 30% — approximately 34 million — of U.S. TV households. It anticipates annual revenue of $3 billion. Stations in six markets, including Springfield, will be swapped or otherwise divested in order to address regulatory considerations. The other five such markets are Portland, Ore.; Nashville, Tenn.; Hartford-New Haven, Conn.; Greenville-Spartanburg, S.C. and Asheville, N.C.; and Mobile, Ala. and Pensacola, Fla. “This merger creates greater opportunities for profitable growth than either company could achieve on its own,” said Media General Chairman J. Stewart Bryan III. “Importantly, shareholders of both companies will benefit from the upside potential of a diversified and strategically well-positioned media company with a strong financial profile and the ability to generate significant free cash flow.” Added Meredith CEO Steve Lacy, “we are excited about the opportunity to create a powerful new multi-platform and diversified media company with significant operations on the local and national levels. Unemployment Rate Steady in New England

BOSTON — The New England Information Office of the U.S. Bureau of Labor Statistics (BLS) has released New England and state unemployment numbers for July. These data are supplied by the Local Area Unemployment Statistics program, which produces monthly and annual employment, unemployment, and labor-force data for Census regions and divisions, states, counties, metropolitan areas, and many cities. Among the highlights of the release:
• The New England unemployment rate was essentially unchanged at 4.7% in July. One year ago, the New England jobless rate was higher, at 5.8%. The New England unemployment rate was lower than the national rate of 5.3%.
• Three New England states posted jobless rates that were significantly different from the U.S. rate of 5.3%: Vermont (3.6%), New Hampshire (3.7%), and Maine (4.6%).
• Over the last year, five New England states recorded statistically significant unemployment-rate decreases, with declines ranging from 1.8% in Rhode Island to 0.5% in Vermont.

She is currently a trustee of Elms College and a member of the executive committee of the Regional Employment Board of Hampden County. BOSTON — The state’s total unemployment rate remained at 4.7% in August, the Executive Office of Labor and Workforce Development announced.

The new preliminary job estimates from the Bureau of Labor Statistics indicate Massachusetts gained 7,200 jobs in August, marking the 12th consecutive month of job gains. Year to date, Massachusetts has added 56,500 jobs.

Preliminary August estimates show the number of employed residents declined by 20,600 and the number of unemployed residents decreased by 2,500, reducing the labor force by 23,100.

Over the year, the state’s seasonally adjusted unemployment rate fell 0.9% from 5.6% in August 2014. The August state unemployment rate remains lower than the national rate of 5.1% reported by the Bureau of Labor Statistics.

“Massachusetts continues to add jobs that strengthen our economy, and the unemployment rate is holding steady, lower than the national average,” Labor and Workforce Development Secretary Ronald Walker II said. “We recognize there are still more than 160,000 people looking for work, and are aligning strategies to better help them find employment.”

The state’s labor-force participation rate — the total number of residents 16 or older who worked or were unemployed and actively sought work in the last four weeks — decreased 0.5% to 65.3%. The labor-force participation rate over the year has decreased 0.1% compared to August 2014.

August 2015 estimates show that 3,424,000 residents were employed and 167,500 were unemployed. There were 33,200 fewer unemployed persons over the year compared to August 2014. The largest private-sector percentage job gains over the year were in professional, scientific, and business services; construction; and information.

The Top Women of Law program celebrates the outstanding achievements made by exceptional women in the legal profession. The awards highlight 50 women who are pioneers, educators, trailblazers, and role models. Fentin is the only honoree from the Pioneer Valley.

Fentin joined Skoler, Abbott & Presser in 1999 and has been a partner at the firm since 2004. Before beginning her law career she had a career in business and owned and operated her own marketing and advertising company. The experience gave her insight into the employment problems faced by many business owners. Today, she specializes in employment-law issues, counseling employers on handling difficult employee situations and avoiding litigation, defending employers against charges of discrimination under state and federal law, and employment litigation in state and federal court.

Her interest in helping employers is evident in her editorship of the Massachusetts Employment Law Letter and her involvement with the Advanced Employment Issues Symposium in Las Vegas. Her passion for employment law has also led her to Cambridge, Mass., where she has held master classes on behalf of M. Lee Smith Publishers on the Americans with Disabilities Act, the Fair Labor Standards Act, and the Family and Medical Leave Act.

BOSTON — The state’s Executive Office of Labor and Workforce Development was awarded a $2.9 million federal grant to expand apprenticeship opportunities in high-growth industries in Massachusetts.

The American Apprenticeship Grant, awarded by the U.S. Department of Labor, will enable the state to help 300 residents gain apprenticeship training in industries with a growing demand for new employees, such as healthcare, technology, and advanced manufacturing.

The funds will support the Massachusetts Apprenticeship Initiative (MAI) to increase the number of apprenticeship and pre-apprenticeship opportunities in those industries. There are more than 7,500 registered apprentices in the state in 2015.

“As many employers in Massachusetts struggle to find the skilled labor to fill available jobs, this grant will enable training for individuals in high-demand industries and provide more job opportunities for the people of the Commonwealth,” Gov. Charlie Baker said.

The U.S. Department of Labor awarded $175 million in American Apprenticeship Grants to 46 awardees across the nation to expand apprenticeships in high-growth industries. The Executive Office of Labor and Workforce Development will use the grant to build upon apprenticeship opportunities and address the skills gap for underserved residents.

“Our team worked incredibly hard to be awarded one of these highly competitive grants,” said Labor and Workforce Development Secretary Ronald Walker, II, who chairs the Workforce Skills Cabinet. “These funds will help us in our mission to meet employers’ demands for highly skilled workers so they can continue to grow their businesses. Businesses cannot grow if they cannot find enough skilled workers.”

Created by the governor through an executive order, the Workforce Skills Cabinet’s goal is to align education, economic- and workforce-development programs, and policies to increase opportunities for training and employment for residents while helping businesses meet their growth needs.

It is September, and by now, thousands of college students have returned to campuses across the region.

Thus, this is a good time to re-emphasize the importance of higher education to this region and its economy. The colleges and universities that call Western Mass. home generate thousands of jobs, purchase products and services from a number of locally based companies, and spur research that can be generated into companies that employ area residents.

But these schools provide another important resource for this region — the students themselves.

They also purchase goods and services, and therefore make an important contribution to the economy, but they play a potentially larger role by taking internships, co-ops, and part-time jobs with companies large and small across the four counties. In doing so, they provide skills, energy, ideas, and the perspective of a generation that will soon dominate the workforce and the consuming public.

It is important for area businesses to take full advantage of this resource — in a careful and thoughtful manner.

Indeed, interns and part-term employees can make valuable contributions to a company — while also positioning themselves for full-time employment later — if they are brought into situations that could be described with the phrase ‘win-win.’

And we encourage both area schools and the business community as a whole to generate more of these situations by creating opportunities for students and employers to meet one another.

Doing so will only benefit all the parties in this equation. But, as we said, it needs to be done properly.

Companies create problems for themselves when they look upon interns as a solution to workforce problems, budget concerns, or both. Too many companies have looked at pressing problems and loaded calendars and responded with the well-worn phrase, ‘let’s get some interns.’

These young people can’t, and should not, be expected to do the work of seasoned employees. Nor should they be thrust into situations where the demands exceed their skill levels.

But, as we said, when interns are placed in proper positions — ones where they contribute and learn — they can be invaluable assets and become future members of a workforce.

Young people can bring energy to a staff, but they can also bring a fresh perspective. Baby Boomers and those who came just behind them can’t look at the world from the perspective of a 21-year-old, but a college junior or senior can, and that kind of insight can be critical, especially in an age when rapidly advancing technology is changing the way people communicate, shop, get their news, market their companies, and gain the public’s attention.

Today’s young people are in many ways driving this change, and they understand it at least as well as those of us born decades before them.

Area colleges are back in session. That’s good for this region in a number of ways. One of the most important is the sum of the contributions students can make to area businesses, nonprofits, and governmental agencies.

This is a tremendous resource, one that should be recognized and capitalized upon.

Cathy Crosky says women owners benefit from having a sounding board comprised of peers navigating similar issues and challenges.

Attorney Paula Almgren says she knows she’s a much better, much smarter businessperson now than she was before she joined a group called WomenUpFront about 18 months ago.

She credits the Pittsfield-based organization, which launched three years ago and is composed of fellow small business owners, with everything from helping her take basic, common-sense steps, such as creating a website for her practice, to developing an appetite for risk taking, including a book she’s planning to write on one of her specialties — navigating community-based care.

“I’ve taken a lot of actions I might not have taken, or would have taken longer to implement, if I wasn’t part of this group,” she said, citing the website as just one example. “And you become accountable to the group; if you say you’re going to do it, you have to do it.”

And yet, Almgren literally can’t wait until she can stop attending the monthly meetings of this group.

Indeed, there is a ceiling regarding annual revenues for membership in this intriguing group — $1 million — and Almgren, who started her practice in 1996, intends to break her way through it sometime soon.

When she does, she’ll be able to ‘graduate’ to a group called the Women Presidents Organization (WPO), which has pretty much the same basic mission statement and MO as WomenUpFront, but is obviously for those with larger ventures and often different challenges.

Transitioning to membership in WPO is the unofficial, usually unannounced ambition of WomenUpFront members, said Cathy Crosky, an executive coach and organizational transformation consultant with Charter Oak consulting group in Williamstown who conceptualized and now leads both organizations.

She told BusinessWest there are many stories like Almgren’s still being written in Berkshire County. They involve women who have found a comfort zone — not to mention myriad learning opportunities — in a group of roughly a dozen that she described early and often as a “sounding board.”

It is now Crosky’s ambition to replicate the success of the Pittsfield group in Hampden County. She noted that statistics clearly show that more women are choosing entrepreneurship as a career path, and the Greater Springfield area is certainly no exception to this rule.

Like the Pittsfield WomenUpFront group, the one planned for Hampden County will be limited to first-stage companies — it is not intended for startups, said Crosky, adding that it is focused on business, not networking, although there is certainly some of the latter as well.

“The idea behind the group is to help women to get beyond the day-to-day challenges and look at the business more purposefully and more strategically,” she said, adding that, to help meet that goal, she has brought in experts on subjects ranging from employment law to time management to address members. “It’s a deep dive into business issues and challenges, and it’s a learning group.”

For this issue and its focus on women in business, we take an in-depth look at the success achieved by WomenUpFront in Pittsfield, and how Crosky plans to make this concept more of a regional phenomenon.

Getting Down to Business

Unlike most members of the Pittsfield WomenUpFront group, Pam Sandler’s immediate goals do not include graduation to WPO.

That may eventually happen, she said, but at present, she’s comfortable with the revenue patterns being generated by the Stockbridge-based architecture firm she launched more than 30 years ago that bears her name and specializes in both residential and commercial work.

Pam Sandler says women have to juggle their lives differently than men do, which leads to unique challenges balancing business and other obligations.

“I was different than other women in the group — I really didn’t want to grow my business; I thought I was stretched as far as I could be stretched,” she said, adding that, generally speaking and economic downturns aside (they traditionally hit this sector very hard), she can generate as much work as she wants and needs to handle. “I was, and still am, far more interested in working smarter — I was getting pretty burned out.”

And, like Almgren, she believes she’s already made significant progress with that goal. As evidence, she cited the fact that she’s not burning as much midnight oil, and not because she has fewer projects on the books.

“I don’t work as many hours as I used to because I don’t have to — I’m working smarter,” she told BusinessWest. “I have less stress, and I’m more focused on the big picture — and I owe much of that to my once-a-month fix.”

That fix, as she called it, WomenUpFront, was in many ways inspired by WPO, said Crosky, adding that she was approached by several women who knew they could benefit from such a group, but didn’t fit the revenue criterion.

Like WPO, the new group was designed to be a forum where common issues and problems can be discussed confidentially, she went on, adding that members soon discover that, whatever challenge they’re facing, they’re certainly not unique, or alone, in that fight.

“The demands of running a business are increasingly more challenging,” Crosky told BusinessWest. “The roundtable provides an opportunity for women to share some of these challenges they have that are similar and offer support, best practices, and ideas — and learn from each other.”

Almgren concurred. “I find that there’s a lot of problem solving in the group — every time I go, I learn something new,” she told BusinessWest. “It’s really helpful as a business owner to be able to talk about what’s working and not working with your business and share ideas with other women business owners.”

Crosky noted that, while some business groups have certainly enjoyed success with a mixed-gender format, the women-only structure of this group appeals to many because of the commonality of issues and a generally shared outlook on business and how to manage.

“Many women report feeling much more comfortable in a women-only group because women lead differently than men and the challenges that women face in the marketplace are different,” she explained. “There’s also the challenge of balancing work and their personal lives, because they do have primary responsibility for children and aging parents, despite the changes in role definition.”

Sandler agreed.

“I find that women have to juggle their lives differently than men do,” she said. “I have three children, and I have to organize their lives and my work at the same time, which has been a real challenge.”

Crosky announced her intentions to form a Pioneer Valley chapter of WomenUpFront in the spring, with the support of the Business Growth Center and PeoplesBank, which have offered to provide meeting space and other forms of assistance.

She’s been working since then to recruit the eight to 10 women entrepreneurs she needs to launch. She knows they’re out there, but she also knows that most individuals who can use help are also those who find it most difficult to commit the time required to be an active participant in such a group.

If she can get a few minutes with a prospective member, she advises them it’s necessary to make the time.

Meeting of the Minds

Crosky said there is no firm timetable for starting the Pioneer Valley chapter of WomenUpFront.

The task of making women aware of the organization and its benefits and convincing them to commit the requisite time and energy is ongoing.

Overall, she believes expanding the concept across the Valley will help individual business owners meet their goals, but also benefit the region in its quest to encourage entreprebeurship and create jobs.

“Not everyone wants to grow beyond $1 million, but everyone wants to be more efficient and stabilize their business,” she said. “And that’s what we’re here for.”

BOSTON — The New England Information Office of the U.S. Bureau of Labor Statistics (BLS) has released New England and state unemployment numbers for July. These data are supplied by the Local Area Unemployment Statistics program, which produces monthly and annual employment, unemployment, and labor-force data for Census regions and divisions, states, counties, metropolitan areas, and many cities. Among the highlights of the release:

• The New England unemployment rate was essentially unchanged at 4.7% in July. One year ago, the New England jobless rate was higher, at 5.8%. The New England unemployment rate was lower than the national rate of 5.3%.

• Three New England states posted jobless rates that were significantly different from the U.S. rate of 5.3%: Vermont (3.6%), New Hampshire (3.7%), and Maine (4.6%).

• Over the last year, five New England states recorded statistically significant unemployment-rate decreases, with declines ranging from 1.8% in Rhode Island to 0.5% in Vermont. In fact, Rhode Island had the largest jobless rate decline nationwide.

Community Spotlight: Westfield, Mass.

Bob Russell and Jeffrey Smith say new zoning was created so Rice Fruit Farm could reopen after sitting vacant for four years, one of many positive developments in the community.

Bob Russell grew up in Wilbraham and has spent most of his life in the town. The selectman is proud of his community and cites work by officials that encourages business growth while keeping a close eye on retaining and expanding the vast amounts of open space and recreational opportunities that can be found on walking and hiking trails crisscrossing the community’s 22 square miles.

He told BusinessWest a 50-year-old time capsule was recently unearthed that contained a statement by town officials who predicted the population would rise to 40,000 residents. “It is significantly less, which speaks to responsible planning and management,” Russell said. “We are not completely built out like some other towns.”

Jeffrey Smith concurred. “We allow for responsible growth and development, particularly in our business districts, which include the town center and Boston Road,” said the chair of the Planning Board. “There are opportunities to construct new homes on single lots and in new subdivisions as well as condominiums. But we put a high value on open space and recreation.”

This value statement was reiterated by Selectman Susan Bunnell.

“We’re in the early stages of another wave of economic development, and informal discussions are taking place between the Select Board and business leaders about how to proceed,” she noted, adding that the state brought fiber-optic cable into the town via the Mass Broadband Initiative activated in the spring, and a committee is exploring whether to expand it because it is currently limited to town buildings and schools.

“We have a municipal light plant that was created last year and are positioned to move to the next level, but we have to determine how to move forward; fiber-optic cable is something businesses have a need for, but any expansion would be done in a measured manner,” she told BusinessWest, adding that she recently attended a statewide seminar on the topic.

But officials also tout the large amount of available space for new businesses and cite potential for success, because much of it is concentrated on the busy stretch of Boston Road that runs through town.

“We have good access to state highways and the Mass Turnpike and good utilities; high-quality water from the Quabbin and adequate sewer capacity,” said Planning Director John Pearsall.

Smith added that Dunkin Donuts just completed a major renovation and expanded its parking lot. “They worked with the Planning Board to come up with a good design,” he recalled, adding that Lumber Liquidators next door has done well, as has the new, $5 million Balise Ford dealership built two years ago.

“There is also a textile mill on Cottage Street off Boston Road under new ownership, and we are in discussion about potential new uses for it,” Smith said, noting that the 200,000-square-foot building sits on 10 acres.

Prioritized Goals

Wilbraham officials say the town welcomes new business, and zone changes are made on a regular basis to accommodate growth.

“Changes were recently passed at the annual town meeting to allow for more retail business in two zones in the center,” said Russell. “They were combined, which will allow properties to be used for retail sales and food-based operations where they could not be established before.”

Pearsall added that the town has a long history of changing its zoning to allow for development, and pointed to the engineering firm FloDesign as an example.

“It was built on abandoned property that was zoned residential; we developed new zoning to allow it to be reused for a business, but were sensitive to the fact that it is surrounded by a residential area,” he told BusinessWest. “It’s the norm in Wilbraham to make adjustments and tweak things to adjust to the changing business climate.”

New zoning has also been put in place for two solar farms. One is permitted at the former landfill, while the second is under review and would be built on private land. “Plus, we constantly approve requests for new residential solar systems,” Smith said.

The iconic Rice Fruit Farm reopened in April, thanks to specific zoning changes created to allow for an adaptive reuse of the property, which includes a farm stand, a food-service operation, and some retail.

“The 100-year-old farm is a landmark in Wilbraham and had been vacant for four years. But the Maloni family came to us with a vision to renovate the existing buildings and create a viable business that would become part of the community, and the town worked with them to make it happen,” Smith explained.

Russell said the opening was well-attended, and residents are glad to see the property brought back to life. “We created a heritage-farmland bylaw to make it happen, and an antique store opened on the property about a year ago.”

The town also allocated $100,000 last year for improvements to sidewalks on Main Street, and hope to expand the project. “The new sidewalks run right past Rice Fruit Farm, and the changes are consistent with items outlined by the Vision Task Force,” Russell said, referring to a 2013 document titled “Wilbraham Looks Forward,” which took residents’ opinions into careful consideration.

Russell says the open space in Wilbraham is one of its main attributes and must be preserved.

“In 2008, Money magazine listed us as one of the best towns to live in, and one of the main factors was our access to open space; there are contiguous hiking trails from one end of town to the other, and we are constantly working to improve them,” he explained. “The town has continued to purchase land when it becomes available, despite the fact that the state cut back on reimbursements.”

To that end, Wilbraham recently approved the new position of land-management coordinator, an official who will inventory all vacant land and work to improve access and recreational opportunities throughout the community.

“Some of the land is under forest management, and we have received money from the sale of timber, which is used to make improvements,” Smith noted.

Officials said the tornado, microburst, and October snowstorm in 2011 pointed out the need for preventive maintenance, and Wilbraham is hosting an annual conference next month for municipal officials, foresters, land trusts, and other groups, which will offer local, state, and regional perspectives on town forests and take participants on a field tour of the community’s forestland to highlight methods and results of sustainable management.

Officials also noted there has been a decided uptick in residential building in the past year.

“The Planning Board recently approved a zoning change for 11 single-family homes in a development that will be called Falcon Meadows,” said Smith. “The land was home to the former Bennett’s Turkey Farm and has sat empty for more than a decade.”

Another subdivision, called Westminster Court, is in the preliminary planning stages and will have seven to 10 lots. Meanwhile, a subdivision known as Carla Lane, which was approved three years ago, is entering Phase III of development. In addition, four lots are still available in the Washington Heights subdivision.

“Building has increased in the past several years, and a number of new townhouses are being built at the Gardens, an over-55 community,” said Building Inspector Lance Trevallion. “Fourteen new single-family building permits have already been issued this year, and I can foresee 15 more by the end of the year.”

He added that the town has a very active and vibrant community garden on a 300-acre parcel of land that is under forest management, and a new greenhouse was just built with Community Preservation Act funding.

In addition, ground has been broken for a new, $8.2 million police station on property adjacent to the fire station, which will be paid for entirely by the town.

“The residents voted for a $4.2 million debt exclusion,” Russell said. “The rest of the cost will be paid out of available funds and bonding capability within the Proposition 2½ levy limit. The cost for the average home will be $78 on the tax bill the first year, which will decline to $49 in year 15 of the bond.”

The Vision Task Force deemed maintaining the beauty and vibrancy of the town important to residents, and although it’s too early to tell how the MGM Springfield casino will affect Wilbraham, officials signed an agreement that provides the town with $100,000 per year for 15 years to mitigate any impact. In addition, Wilbraham will receive a $100,000 consultant fee in the casino’s first and fifth operating years to examine whether the financial repercussions total more than $100,000.

“It is foolish to try to predict the future. But town officials and department heads have created a baseline on our traffic, water, and sewer use,” said Russell. “We will re-measure these things in the future; it’s important because part of the town uses the same sewer line as Springfield, and we get a good portion of our water from Springfield and the Quabbin Reservoir.”

Moving Forward

Russell likes everything about his hometown.

“It is only getting better, and college graduates who grew up here tell us they hope they can afford to raise their children in Wilbraham. We used Community Preservation Act money to revamp the Children’s Museum this year, and Sevey Park is being completely re-landscaped. Our teacher-student ratio is very low, and we have a new, $63 million regional high school,” he told BusinessWest, listing attributes that appeal to families.

“In the last two years, we have not fully exercised the tax-levy limit under Proposition 2½, despite the fact that we have increased our savings and funding for other post-employment benefits for former town employees,” he added. “We have a lot to be proud of, but it’s all about balance — and our citizens consistently vote to develop and grow in a very responsible manner.”
