EASTHAMPTON — Hometown Financial Group Inc., the multi-bank mutual holding company for bankESB, bankHometown, and Abington Bank, has completed its acquisition of Randolph Bancorp Inc, the bank holding company for Envision Bank. Under the agreement, the acquired Envision Bank branches have been rebranded as Abington Bank.

This transaction is the sixth strategic merger for Hometown in the last seven years. In 2015, Hometown acquired Citizens National Bancorp. GRANBY — James Sullivan, president of the O’Connell Companies Inc., announced that the board of directors has appointed Bryan Hughes as the new president of Western Builders Inc., a wholly owned subsidiary, effective Oct. 3.

BOSTON — Confidence among Massachusetts employers weakened slightly last month amid growing economic storm clouds both nationally and in Massachusetts.

The Associated Industries of Massachusetts (AIM) Business Confidence Index lost 1.4 points to 53.9, its lowest level since June. The Index now rests 5 points lower than its level of a year ago.

The decrease reflects the swirl of contradictory elements roiling the economy — surging inflation, rising interest rates, and shrinking economic output on the one hand and a persistently strong demand for workers on the other.

The September survey responses came as the Federal Reserve raised interest rates another three-quarters of a point on Sept. 21 and the financial markets closed out their worst month since March 2020.

“Companies remain concerned about inflation, the cost of borrowing, and the potential for a recession, but their primary concern remains finding the employees they need to enable growth and maintain operations. Many businesses have been able to increase product prices to compensate for rising costs and have thus sustained or increased their payrolls,” said Sara Johnson, chair of the AIM Board of Economic Advisors (BEA).

The AIM Index, based on a survey of more than 140 Massachusetts employers, has appeared monthly since July 1991. It is calculated on a 100-point scale, with 50 as neutral; a reading above 50 is positive, while below 50 is negative.

The constituent indicators that make up the Index were mostly lower during September. The confidence employers have in their own companies declined 3.6 points to 54.9, ending the month 5.8 points lower than in September 2021. The Massachusetts Index assessing business conditions within the Commonwealth dipped into pessimistic territory by losing 6.6 points to 47.5. The U.S. Index measuring conditions throughout the country surged 10.3 points to 57.1, leaving it 4.6 points better than in September 2021.

The Current Index, which assesses overall business conditions at the time of the survey, lost 1.4 points to 55.0. The Future Index, measuring projections for the economy six months from now, fell 1.5 points to 52.7.

The Manufacturing Index rose tumbled 7.4 points to 49.1, well below the 59.2 reading for non-manufacturing businesses. Medium-sized companies (58.0) were more optimistic than small companies (51.5) or large companies (52.0).

Katherine Kiel, professor of Economics at the College of the Holy Cross and a BEA member, said employer confidence is being shadowed by uncertainty during the second half of 2022.

“Business owners and CEOs find themselves amid a swirl of trends that include the post-COVID recovery, a tight job market, healthy consumer spending, rising prices, increased borrowing costs, and even the prospect of a pandemic resurgence during the winter,” Kiel said. “Lurking behind all of these issues, the Conference Board forecasts that economic weakness will intensify and spread more broadly throughout the U.S. economy in the second half of 2022 and expects a recession to begin before the end of the year.”

AIM President and CEO John Regan, also a BEA member, said Massachusetts employers remain hopeful that the Massachusetts Legislature will pass some version of an economic-development bill that was shelved on Aug. 1 as lawmakers attempted to digest the fiscal impacts a $3 billion tax rebate heading for taxpayers in November.

“The economic development bill includes key provisions for employers, including recapitalization of the Unemployment Insurance Trust Fund and reform to the estate tax,” Regan said. “AIM continues to work with the Legislature to find a way to enact this important piece of legislation.”

CHICOPEE — Elms College has named higher-education executive Andrew Coston the college’s new vice president of Student Affairs. Reporting directly to the president, Coston is responsible for the strategic oversight and management of the college’s Student Affairs office.

“I am excited to welcome Dr. Coston to Elms College,” Elms College President Harry Dumay said. “His experience in student affairs administration and career development will be a welcome addition to Elms College, and I look forward to working with him on the strategic direction of the college.”

Coston is joining Elms from Gustavus Adolphus College (GAC) in Saint Peter, Minn., where he recently served as assistant dean of students and executive director of GAC’s Center for Career Development. Prior to that, he was director of Career Services at Cecil College in Maryland.

In his new role at Elms, Coston is responsible for providing leadership, management, and supervision to the dean of students, the director of Campus Ministry, the director of Residence Life, and director of the Health Center. Additionally, he is a member of the president’s cabinet.

Coston has more than 20 years of higher-education experience in student affairs and career services. He holds a doctoral degree in education from Morgan State University in Maryland, a master’s degree in school counseling from Loyola College in Maryland, and a bachelor’s degree in psychology from Assumption College in Worcester.

On Thursday, Oct. 6 at 4 p.m., some of the region’s most talented bakers will come together at the Naismith Memorial Basketball Hall of Fame to support Square One in its first-ever “Cookies & Milk” fundraising event. Guests will be treated to a variety of cookie samples from participating vendors and will then have an opportunity to vote for their favorites. In addition to the sweet treats, guests will enjoy hors d’oeuvres and cookie-themed cocktails.

The event, which will also include raffles and a silent auction, has title support from PeoplesBank and the Naismith Memorial Basketball Hall of Fame.

SPRINGFIELD — Dress for Success Western Massachusetts (DFSWM) announced achievements by all three of its staff members. Their commitment to empowering women to attain economic independence has made the organization a standout among 144 Dress for Success Worldwide affiliates, and has grown the organization in spite of challenges presented by the COVID-19 pandemic.

Executive Director Margaret Tantillo is one of only 16 executive directors from around the world invited to join the inaugural Dress for Success Worldwide Affiliate Advisory Council. Representing the Northeastern U.S., Tantillo will give input to determine how Dress for Success will move forward and provide support throughout the affiliate network. According to Worldwide, “as an established affiliate with solid programming, we feel that Margaret’s participation in the council will bring unique insights that can benefit the entire organization.”

DFSWM does, in fact, have solid programming. In addition to its signature interview suiting, it has graduated 11 cohorts from its Foot in the Door workforce-development program in under six years, and is currently launching the 12th class. In less than three years, the Margaret Fitzgerald Mentorship Program has quadrupled the number of mentees paired with professional women in the community. DFSWM has also established a Professional Women’s Group to support participants looking to advance their careers and gain leadership skills. And in response to the needs of local women during COVID, it has established a digital-literacy coaching program that has provided more than 400 hours of one-on-one learning.

Overseeing this advancement is Jess Roncarati-Howe, who has been promoted to director of Programs and Operations. Having been hired in January 2020 as a part-time program coordinator, Roncarati-Howe quickly advanced, expanding programming, fostering community relationships, and responding to the needs of local women seeking gainful employment during and post-pandemic. As the former executive director of the Greater Chicopee Chamber of Commerce and the AIDS Foundation of Western Massachusetts, she is uniquely qualified to develop programs that target the needs of the local workforce while meeting participants wherever they are in their lives.

The overall success of DFSWM would not be possible without its more than 100 consistently active volunteers. This group of women supporting women is led by Volunteer Engagement Manager Diane Jacobs, who brings a distinct combination of facilities management, event coordination, and office oversight experience to the role.

Having joined the staff in September of 2019, Jacobs has established structure, enthusiasm, and a culture of gratitude that ensure an ever-growing roster of committed volunteers. Most recently, she has led the Volunteer Engagement Committee to the completion of a volunteer handbook that has been recognized as a resource by Dress for Success affiliates across the globe.

She has also, over the last two years, coordinated the largest and most successful tag sales in the organization’s history and brought DFSWM to the table for initiatives such as United Way of the Pioneer Valley Women’s Leadership Council’s Power of the Purse and the Suited for Growth program in collaboration with Follow My Steps and Bay Path University.

FLORENCE — Florence Hearing Health Care (FHHC) is encouraging people of all ages to prioritize their hearing healthcare during Audiology Awareness Month this October. Florence Hearing is excited to see more people talking about their hearing healthcare this month as Audiology Awareness Month coincides with the launch of over-the-counter (OTC) hearing aids being made available this month.

The American Academy of Audiology started Audiology Awareness Month in 2008 as a means of bringing awareness to hearing health and the importance of hearing protection. Florence Hearing is urging the community to help it encourage anyone who has been wondering about their hearing, regardless of age, to get a hearing test. According to the National Institute on Deafness and Other Communication Disorders, even though 13% of the population has hearing loss, only 16% of adults ages 20-69, and 30% of adults over age 70, with hearing loss use hearing aids. Untreated hearing loss can have a significant impact on the quality of life for those experiencing it, such as social isolation. It is also associated with other conditions, such as depression, anxiety, and cognitive decline.

OTC hearing aids are an option for people with mild to moderate hearing loss, but with many brands likely to hit the market, a patient may need to do some research to determine which device meets their hearing loss and lifestyle needs. Florence Hearing is encouraging folks to consider OTC hearing aids as the hearing equivalent to reading glasses. Florence Hearing always recommends the first step in any individuals’ hearing healthcare journey is to get a hearing test with an audiologist, even if the patient will be purchasing OTC devices. In addition to getting a hearing test beforehand, the staff at Florence Hearing encourages people to follow up with an audiologist if they find the OTC devices are not helping.

Audiologist Jennifer Sowards, Au.D., owner of Florence Hearing, points out that an important aspect that is missing from the OTC delivery model is the support that an audiologist provides, such as helping patients reacquaint their brains to sound after experiencing hearing loss, called aural rehabilitation.

“They are an appropriate starting point; however, it is still important to see an audiologist for your hearing evaluation to determine whether or not they will help you,” Sowards said. “We are hopeful that this launch will lead to more folks experiencing the positive benefits of treating their hearing loss.”

A baseline hearing test is recommended for folks over age 50 and for anyone who has a perceived change in their hearing and/or tinnitus. An audiologist will do a thorough diagnostic evaluation to make sure there are no underlying, potentially treatable conditions causing the hearing loss and whether further consultation with a healthcare provider is needed.

“Hearing aids aren’t hearing cures, and most folks require a level of in-person support to be successful with using them,” Sowards said.

Florence Hearing encourages the community to manage their hearing healthcare as they do other regular healthcare, like dental and eye care, and recommends that people get a baseline hearing test by age 50, understand the results and any recommendations, and have access to recommended communication solutions in a no-sales-pressure healthcare setting.

WEST SPRINGFIELD — A total of 1,603,354 visitors attended the 2022 Big E in West Springfield. During the fair’s 17-day run, an all-time single-day attendance record was set when 177,789 visitors arrived on Saturday, Sept. 24. Five additional daily attendance records were also set.

The event featured a diverse concert lineup of more than 80 individual performances, plenty of fair foods, rides, and unique shopping experiences. The tradition continues next fall from Sept. 15 through Oct. 1, 2023.

SPRINGFIELD — American International College (AIC) named Michael Eriquezzo associate vice president for Marketing and Communications. He oversees the Office of Marketing and Communications and is responsible for advertising, design, web management, public relations, branding, and internal and external communications, including Lucent magazine, a publication with a print distribution of 26,000.

Eriquezzo joined AIC in 2017 as the chief graphic designer and visual brand manager for the college. He received a bachelor’s of business administration degree in marketing from the Isenberg School of Management at UMass Amherst.

Meanwhile, Tami Christopher has joined AIC as executive director of Student Success and Opportunity, tasked with leading the Center for Navigating Educational Success Together (NEST), which encompasses the James Shea Library along with advising, tutoring, accessibility and accommodations, and other specialized support initiatives that facilitate and support students’ educational success via student-centered educational services.

Christopher brings more than 10 years of experience supporting the post-secondary success of students, particularly those from traditionally marginalized communities. She has held leadership roles with Post University, the University of Bridgeport, and Middlesex Community College in Connecticut. She has supported post-secondary access and opportunity initiatives through research, policy, and program design work with CT Voices for Children, Our Piece of the Pie, and Ready CT.

She has worked closely with current U.S. Secretary of Education Miguel Cardona on early college program development and has collaborated on college access and success initiatives nationally, including in Colorado, Maine, Rhode Island, and Texas. She earned a doctorate in educational leadership from the Harvard Graduate School of Education.

In addition, Millie Lopez-Cook has been hired as director of Human Resources and deputy Title IX coordinator. She will have oversight and responsibility for recruiting, training and development, employee relations, compensation management, health and welfare benefits, record management and diversity, equity, and inclusion for AIC. Additionally, as deputy Title IX coordinator, she will serve in an investigative role and ensure the timely resolution of reports of sex discrimination, sexual misconduct, or harassment.

Lopez-Cook brings to AIC an extensive background in human resources professionally in the nonprofit and for-profit sectors and as an academic, having taught human-resource management, organizational behavior, labor relations, and business management at the college level. She graduated with a master’s degree in science management from Albertus Magnus College in Connecticut.

The past few years have been difficult for many, for a multitude of reasons. The event will feature inspiring speakers who have begun sparking change in their communities.

HOLYOKE — After a three-year pandemic pause, the annual Leslie Phillips Festival, an evening of short plays written, directed, and staged in 24 hours, returns next week to Holyoke Community College (HCC).

HCC theater alumni and students will assemble on the evening of Friday, Oct. 7 to begin brainstorming ideas and writing plays they will perform the next night, Saturday, Oct. 8, beginning at 7:30 p.m. in HCC’s Leslie Phillips Theater.

The annual benefit, last held in 2019, honors the legacy of Leslie Phillips and raises money for the Leslie Phillips Theater Fund for Arts and Education.

The festival was first organized in 2016 by HCC alumni working with HCC Theater Professor Pat Sandoval as a tribute to Phillips, founder of the HCC theater program, who died in 1988 after inspiring legions of HCC students.

“This is an evening of creativity and collaboration for the HCC theater community and the community at large,” HCC alumna and festival coordinator Lisa Poehler said. “It’s also a chance to invest in the future generation of HCC’s theater program and students, all in the name of our beloved mentor, Leslie Phillips.”

After the show, festival attendees are invited to help commemorate the 50th anniversary of the HCC Players, the theater group founded in 1972 and led by Phillips until her death.

Funds raised from the festival enable the HCC Theater Department to hold master classes, make capital improvements, and hire guest artists — “anything to enrich, enable, and expand the educational experience of HCC students,” Poehler said.

Let the Buyer Beware

Historically, non-competition agreements have been a useful tool for employers to protect their businesses, financials, and proprietary information when a departing employee leaves the company to work for a competitor. Over the past decade, the ways in which non-competition agreements can be used has been restricted.

Indeed, Massachusetts has significantly limited the functionality of non-competes, and California has barred them altogether. Recently, the federal government, vis-a-vis the Federal Trade Commission, has limited their use in corporate mergers and acquisitions.

“In October 2018, Massachusetts practically banned non-competes through the creation of very specific and strict requirements. As a threshold matter, non-competes in Massachusetts cannot be freely used and, rather, must protect a legitimate business interest.”

Just four years ago, in October 2018, Massachusetts practically banned non-competes through the creation of very specific and strict requirements. As a threshold matter, non-competes in Massachusetts cannot be freely used and, rather, must protect a legitimate business interest. The definition of legitimate business interest is limited to trade secrets, confidential information of the employer that otherwise does not qualify as a trade secret, or the employer’s good will.

Other alternative restrictive covenant, such as non-solicitation, non-disclosure, and/or confidentiality agreements, must be explored prior to resorting to a non-compete.

Massachusetts further tightened up the ability to implement non-competes by creating a litany of other requirements. The non-compete must:

• Be in writing;

• Be signed by both the employer and the employee and state that the employee has a right to consult a lawyer before signing the agreement;

• Provide notice of the agreement to the employee (the notice requirements change depending on when the employee is asked to sign the agreement); and

• Occur at the beginning of employment or provide notice of the agreement no less than 10 business days before the agreement would become effective and provide additional compensation.

The conduct the agreement seeks to prevent must not violate the public interest. Generally, public policy favors an employee’s ability to move from one job to another without restriction. Only a narrowly tailored agreement to protect a legitimate business interest will fit within public policy.

It is against public policy in Massachusetts to allow for non-compete agreements in certain professions. Non-competes signed by nurses, physicians, psychologists, social workers, and certain employees of broadcasting companies are considered void in Massachusetts. This is to protect public health and the free flow of information and ideas. A non-compete agreement in any of these areas is unenforceable as a matter of law.

Additionally, a non-compete agreement is not valid against a low-wage employee. The law states that employees who are classified as ‘non-exempt’ (typically, employees eligible for overtime pay and hourly wages) under the federal Fair Labor Standards Act may not be required to sign a non-compete agreement.

Non-competes are also prohibited or unenforceable when an employee is terminated without cause or laid off. These workers are not bound by the terms of any non-compete agreement that they have already signed with their employer.

Now, on the federal side, non-competition agreements are coming under scrutiny through corporate mergers and acquisitions. The primary rationale for restricting them is public-policy concerns.

Traditionally, non-compete agreements as part of a corporate merger or acquisition were quite broad in scope and geography. The reason for their broad coverage makes sense: the sale of a business is primarily based upon good will. Buyers understandably would require broad non-competition coverage so, post-sale, they are not competing against a seller who may start or work for a competitor company. In other words, in a business sale, to protect its interest in the business, the buyer would want to restrict the seller’s ability to compete against it.

However, the Federal Trade Commission recently restricted the ability of a buyer to require broad, sweeping language in non-competes. Rather, they must be limited to what is specifically needed to protect portions of the business.

What does all of this mean for companies? Knowing how to properly craft a valid, legally enforceable non-competition agreement is paramount. As with other restrictive covenants, non-competition agreements should be used sparingly and tailored as narrowly as possible to adequately protect your client’s legitimate business interests without being overly restrictive to the employee.

Generally, a one-year duration is considered to be reasonable. Depending on the circumstances, it may be possible to protect your client with a non-compete that has a shorter enforcement period. Again, as a rule of thumb, the shorter the length of restriction, the more likely the non-compete will be enforceable. It may also make sense to explicitly prohibit competition during employment.

Giving Them the Business

More often than not, a family business is doomed by the failure of the owners to plan for its continuation. Currently, only 30% of family-run companies succeed into the second generation, and only 15% percent survive into the third generation. Fortunately, with proper planning, most business owners can ensure the continued operation of their business should they become incapacitated or pass away.

Contemplating one’s mortality is not a pleasant activity. Most believe they have plenty of time to plan. Some business owners identify so closely with their business that they simply cannot comprehend the idea of their business being operated by anyone other than themselves. However, when a business owner becomes incapacitated or passes away without a plan in place, the business always falters and often fails.

The general recommended time to plan for business succession is between the ages of 55 and 65. This timeframe is recommended because most successful business-succession plans include several steps carried out over time. Some succession consultants recommend a three- to five-year plan, while others advocate a five- to 10-year plan. Adequate planning time allows a business owner to test potential successors in different roles and to evaluate their maturity, commitment, business acumen, and leadership abilities. Further, once a successor is chosen, adequate lead time allows the successor to gain expertise so that the business does not falter when the former business owner leaves the business.

More often than not, the head of a family-owned operation chooses a child as a successor. Commonly, more than one child is competent to step into the parent’s shoes, which makes the selection process even more difficult. When a family member is not available, a key employee often fits the bill. Typically, these employees have already displayed the abilities necessary for operating the business.

The business owner should begin by determining three things: when they want to step away from the business, for how long they want to remain active in the company thereafter, and in what capacity they wish to remain involved. Next, the business owner needs to discuss their ideas about the future with their family, senior management team, and key employees. Thereafter, the business owner should begin working with the successor to revise their business plan, thereby allowing them to include any future new products, plans for expansion, growth, or new investment, as well as a candid assessment of the company’s current environment and competitive positioning.

The business owner will also want to develop a financial strategy for actually stepping fully away from the business. A financial strategy, which is perhaps the most significant activity associated with succession planning, protects the company, the family, and the employees against a monetary burden that could doom the entire process to failure. For example, if a business owner intends to leave the business to their children, they must consider any estate taxes their estate may face upon their passing that may require the liquidation of the business, despite best intentions.

It is also critical to obtain an accurate valuation of the business regardless of who will take over or inherit the enterprise. Such a valuation encompasses tangible assets, such as real estate, buildings, machinery, and equipment, as well as intangible assets, such as employee loyalty, manufacturing processes, customer base, business reputation, patents on products, and new technologies. Employing a professional valuation company is recommended, as there are many different factors that affect the value of a business.

Once the business has been valued, it is necessary to determine the method of transferring the business. Some options for transferring a business include gifting, the use of a trust, buy-sell agreements, and life-insurance-funded plans. The choice of successor will strongly influence this decision. Surely, a plan that gives the business to children or family members would differ greatly from a plan that requires a third party to purchase the business owner’s interest. When transferring to a child or related party, the business owner may gift some of the company’s value, whereas, when transferring to an independent third party, the business owner would most likely want to be paid the full fair market value of the business.

As various plans may be established and the specifics of the business must be considered, each different plan must be reviewed on its own merits. The process of choosing a succession plan involves numerous factors, and there are many pitfalls along the way. Thus, it is best to consult with the necessary professionals, such as attorneys, financial advisors, and accountants, to assist with the transition and to allow as much time as possible to plan and make the transition. By doing so, business owners can ensure the vitality of their business for many years to come.

Case in Point

A recent decision from the Massachusetts Supreme Judicial Court (SJC), Commonwealth v. K.W., clarifies the standard for persons seeking to expunge records of criminal court appearances and dispositions from their state criminal records (known as Criminal Offender Record Information, or CORI) and court and criminal justice agency records.

By way of background, it is important to first understand that in Massachusetts, individuals may seek to clear their CORI in one of two ways: through sealing or expungement. If sealed, the record still exists but is unavailable to the general public. If expunged, the record no longer exists.

Petition to Seal Record (Mass. General Laws, Ch. 276, Secs. 100A-100D)

With some exceptions, one can petition the commissioner of Probation to seal disposed cases after a period (three years for misdemeanors and seven years for felonies) beginning on the later of the date of a guilty finding or release from incarceration, with no intervening criminal convictions. A judge can allow immediate sealing if the charge ends with a finding of not guilty or no probable cause, dismissal, or nolle prosequi, and must allow a petition to seal for first-offense convictions (with successful completion of probation), not-guilty findings, dismissals, or nolle prosequi of possession of marijuana or Class E controlled substances or in the presence of a person in possession of heroin, as well as decriminalized offenses.

For other offenses, sealing is discretionary, and the petitioner must show ‘good cause’ — that continued public availability of the record creates a current or foreseeable future disadvantage. If sealed, the courts will report ‘no record’ to criminal background checks, and the individual, if asked (such as on an employment application), can report having no record as to the sealed offense. However, courts, police, criminal-justice agencies, and certain other entities still have immediate access to sealed records.

Petition to Expunge Record (Mass. General Laws, Ch. 276, Secs. 100F-100P)

In 2018, as part of the Criminal Justice Reform Act, the state Legislature created two pathways for individuals to seek expungement. Following the first pathway (referred to as ‘time-based’ expungement), individuals who, before age 21, committed certain low-level offenses may apply to expunge those records.

Following the second pathway (known as ‘reason-based’ expungement), an individual can seek expungement of juvenile and adult criminal court appearances and dispositions by presenting ‘clear and convincing evidence’ that the record was created as a result of false identification or unauthorized use or theft of identity of the petitioner; fraud perpetrated on the court; ‘demonstrable’ error by law enforcement, witnesses, and/or court employees; or an offense that is no longer a crime.

There is a ‘strong presumption’ in favor of expungement of records created as a result of one of the statutory factors. That said, expungement is not automatic. A judge has discretion and must still balance that presumption against any ‘significant countervailing concern’ that may be raised when deciding if expungement is ‘in the best interests of justice.’ If none are raised, the judge must order expungement.

An expungement order results in permanent erasure and destruction of the record of the qualifying offense. Expungement of the record for a qualifying offense will have no effect on the existence of other records related to the same or other incidences.

Sealed or Expunged Records

It is important to understand the policy reasons that support the sealing and expunging of records. As the SJC noted in its recent decision, whether to seal a record ultimately relies on a defendant’s and the Commonwealth’s interests in keeping the information private, which includes “reducing recidivism, facilitating reintegration, and ensuring self-sufficiency by promoting employment and housing opportunities for former criminal defendants.”

With regard to expungement, the SJC stated that by specifically creating the qualifying reason-based factors, the Legislature itself had identified a good cause basis for expungement. Records created as a result of one of those factors “have virtually no bearing on whether the petitioner might commit a criminal act in the future, and their value to society therefore is vanishingly small.”

Once sealed or expunged, a record cannot disqualify a person from examination, appointment, or application for employment with any government agency, or in determining if that person is suitable for the practice of any trade or profession requiring a license.

Any application for employment that seeks information concerning prior arrests or convictions must contain the statements required by the statutes relating to sealing records and expungement of records regarding the applicant’s ability to answer ‘no record’ when records have been sealed or expunged. Employment applications should be reviewed to ensure compliance with the required language.

This article gives a general description of sealed and expunged criminal records. However, procedures for and the effects of sealing and expungement are complicated. Therefore, interested individuals should carefully review Massachusetts General Laws, Chapter 276, sections 100A-U, or seek advice from an attorney.
